2.4 Legal & Regulatory Framework

Key legislation includes the Housing Act (No. 107 of 1997), the National Building Regulations and Building Standards Act (No. 103 of 1977), the Spatial Planning and Land Use Management Act (SPLUMA, No. 16 of 2013), the Sectional Titles Schemes Management Act (No. 8 of 2011), the Community Schemes Ombud Service Act (No. 9 of 2011), and applicable municipal by-laws.
All developments will be registered with the NHBRC. Construction will comply with SANS standards and be overseen by registered professionals. HOA constitutions will be drafted in compliance with applicable community scheme legislation, with provisions for transparent governance, dispute resolution, and financial management.
