8.2 Compliance as a commercial asset
Compliance in this industry is universally required and unevenly delivered. That gap is the Company’s commercial position. A corporate procurement department placing a duty-of-care arrangement now asks for evidence — current registrations by officer, competency certificates, the control room, the insurance schedule, the incident record — and an operator who can produce that pack within a day is competing against a field that largely cannot.
PSIRA registration is also an event of default under the term facility. A lapse is therefore not an administrative irritation but a credit event, which is why registration currency by officer is reported as a key performance indicator in Section 19 and certified quarterly to the lender.
8.3 Broad-based black economic empowerment
|
Element |
Position |
Commercial effect |
|---|---|---|
|
Ownership |
Majority black-owned at establishment |
A material scoring advantage in corporate procurement |
|
Management control |
Black executive management from establishment |
Scored separately from ownership |
|
Skills development |
The academy generates verifiable spend and outcomes |
The academy contributes to the scorecard as well as to the officer pipeline |
|
Enterprise and supplier development |
Sub-contracted specialist services where appropriate |
Modest contribution; not a driver of the plan |
|
Verification |
Annual verification by an accredited agency |
Required by most corporate clients as a condition of tender |
Empowerment credentials are a condition of access to a substantial part of the corporate market rather than a differentiator within it. The academy is unusual in contributing to both the scorecard and the operational pipeline, which is a genuine structural advantage over competitors who buy skills development compliance without gaining an input.
